When are you not covered?

a. Any claim where you have not met the terms of your rental agreement.

b. Any claim where a contravention of the local laws has taken place resulting in a court action.

c. Trailers, camper trailers, motorcycles, scooters/mopeds, motorhome/RVs that have a built-in shower or toilet, vehicles driven on unsealed roads except where the unsealed road is an access road to your accommodation venue & minibuses.

d. If you are not covered for third party property and third party personal damages, please purchase it at the rental desk.

 
"Not at fault" accidents

In the event that you have paid expenses to the rental company that would be refundable because you are "not at fault", the Claims Team will outline a process whereby you will be reimbursed expediently (subject to the rental company's cooperation).

Terms and Conditions

If, during the rental period, you are responsible for any loss or damage to a Rental Vehicle as shown below, we will reimburse you up to the amounts shown in the Benefits Table that you have to pay in respect of such loss or damage: 

Theft of Vehicle

You are covered for any costs incurred in relation to an incident of theft, vandalism or attempted theft.

Windscreens, Headlights & Other Lights

You are covered for any windscreen, glass or light damage costs including chips, cracks, replacement and fitting.

Tyres

You are covered for any costs incurred in relation to tyre puncture repairs or replacement.

Key Coverage

You are covered for any costs incurred in relation to replacing a lost or stolen rental vehicle key, including replacement locks and locksmith charges & key delivery. You must follow the guidelines prescribed by the rental company.

Towing & Roadside Assistance Costs

You are covered for any towing or roadside assistance costs following physical loss or damage to or mechanical breakdown of the rental vehicle which results in a charge to you that has not and will not be reimbursed by the rental company. In the event that the towing charges derive from a “loss of key” or similar key-related issue, the driver must follow the process and guidelines prescribed by the rental company. If a towing company attends to the vehicle rather than an authorised locksmith, and where the rental company's process guidelines have not been followed, related costs will not be recoverable through this Plan.

Administration Costs

You are covered for any rental company charges associated with processing your collision or damage event. These include but are not limited to handling fees, carriage fees, postal fees, accident fees, administration fees or anything of a similar nature.

Drop Off/Relocation of Vehicle

You are covered for any drop off charges you incur in the event of an accident that necessitates the relocation of a vehicle from the accident site.

Loss of Use Charges

You are covered for any rental company charges related to the loss of use or sale of the rental vehicle whilst it is off the road being repaired (also called "demurrage").

 

 

 

General conditions / eligibility requirements that apply to the whole Plan

All of the following conditions and/or eligibility requirements must be met for you to qualify for reimbursement:

  1. Your name must be on the rental agreement. Other drivers that are on the rental agreement with you are also covered.
  2. You must accept the terms and you must not have breached any terms of the rental agreement.
  3. Coverage is limited to one Rental Vehicle at a time.

General Exclusions that apply to the whole Plan
 

We will not pay claims incurred directly or indirectly as a result of or in relation to:
  1. Bodily injury;
  2. Loss, theft or damage to your personal property;
  3. Damage or loss arising directly or indirectly from:
    1. The operation of the Rental Vehicle when You are driving while intoxicated or under the influence of a narcotic drug;
    2. Any dishonest, fraudulent or criminal act committed by You;
    3. The transportation of contraband or illegal trade;
    4. Participating in a speed contest or race;
    5. Operation of the Rental Vehicle off of publicly maintained roads except where the road is the sole access road to your accommodation venue;
    6. Intentional damage to or neglect of the vehicle by You;
    7. Inherent vice or damage, insects or vermin;
    8. War, hostile or warlike action, insurrection, rebellion, revolution, civil war, usurped power, or action taken by government or public authority in hindering, combating or defending against such action;
    9. Seizure or destruction under quarantine or customs regulations or confiscation by order of any government or public authority;
    10. Trailers, camper trailers, motorcycles, scooters/mopeds, motorhome/RVs that have a built-in shower or toilet, vehicles driven on unsealed roads except where the unsealed road is an access road to your accommodation venue & minibuses.

Claims
 

Complete the claim form on www.rentalcover.com/claim explaining in detail the reason for the claim.
Documents required:
  1. Final invoices from the rental company and repair companies (windscreen repairers, smash repairers, assessment providers etc.) showing:
    • The cost of all repairs undertaken
    • The total charges from the rental company in respect of your excess and other charges related to the accident.
  2. Other documents as requested by your claims officer.
  3. All correspondence and documents shared between you and the rental company.
  4. Accident or damage report.
  5. Police Report, if applicable.
• We may reject a claim if it is deemed that the evidence provided is not compatible with the documents requested.
• Claims payments will be paid based on a published transfer rate rather than a mid-market rate, in a currency appropriate for the Plan holder's Country of Residence.

General Provisions

Other Insurance 

If, at the time of a valid claim under this Plan, there is an insurance policy in force which covers you for the same loss or expense, you must give RentalCover.com full details of the other policy. We will only pay our proportional share of any claim.
 
Notice to Authorities


Where the loss is, or is suspected to be, due to malicious acts, burglary, robbery, theft, or attempted theft, you must give immediate notice of such loss to the police or other law enforcement agency having jurisdiction.
 
Subregation

We will assume all your rights of recovery and bring action in your name to enforce these rights. In the event that RentalCover.com has paid a claim to you and you are eligible for a future reimbursement by the car hire company (for instance if you are deemed to have not been the driver who was "at fault").
 
False Claim

If you knowingly make a false or fraudulent claim in any respect, you will not be entitled to any coverage or benefits under this Plan nor to the payment of any claim under this Plan, and we will enforce our rights of recovery for any claims that have been paid. 

Data Protection Act 1998

We may store, use and process your personal information in order to administer your Plan and provide you with our services; identify other products and services that might be suitable for you; renew your Plan with us and keep our records about you up to date. We may also use the information to prevent and detect fraud and/or money laundering or similar activity. Under the Data Protection Act 1998 you are entitled to a copy of the information we hold about you on request, upon payment of the relevant fee. Please let us know if you think any information we hold about you is inaccurate so that we can correct it. The information we hold about you is confidential. We will only ever disclose it to another party with your consent, for the purposes of contacting you about other products or services, if the law requires us to disclose it and/or to our agents providing services to you.

We may monitor and record phone calls to help maintain our quality standards and for security purposes.

Jurisdiction and Law

You and we are free to choose the laws applicable to the Plan. Unless otherwise agreed by us in writing the law applicable will be English Law.

The Cancellation Terms allow you to cancel the Plan without cause and in doing so you will obtain a full refund of premium, provided the rental agreement has not commenced and you have not reported or intend to report a claim. 

Reimbursment Plan Issuer

This Plan is provided by Cover Genius Ltd.

Period of Cover

This Plan is valid for policies issued providing you have paid the appropriate premium, as shown in your certificate of cover. This is the period for which we have accepted the premium as shown in your certificate of cover. During this period any rental agreement must not exceed 365 days. This would include not covering you, regardless of your incident date, for any claim that relates to a booked rental agreement that is longer than 365 days in respect of a single rental agreement. 

 
Complaints/Disputes 

If you have a complaint concerning the financial product or services provided to you, Cover Genius Pty Ltd will endeavour to resolve your complaint as soon as possible, usually within 1 business day. If you remain dissatisfied with the solution Cover Genius Pty Ltd offers, we will refer the matter to our Internal Dispute Resolution (IDR) Facility. Please provide details via phone (+61 2 8274 2898), mail (9 Barrack St, Sydney NSW 2000) or email ([email protected]). Cover Genius Pty Ltd undertakes to acknowledge your complaint and respond with a final decision within 15 business days. In the event the dispute remains unresolved following the IDR Process you may discuss the matter further with the Financial Ombudsman Service (FOS). The Financial Ombudsman Service (FOS) is a free dispute resolution service to consumers who may be in dispute with their insurer. FOS will indicate whether they can assist you with your complaint as this service is not available to all customers/products. You must contact FOS within 3 months of receiving a final decision from the IDR process. Decisions by FOS up to a certain amount are binding on an insurer. Legal action is still available if you disagree with the FOS decision.

The relevant party will contact you within five days of receiving your complaint to inform you of what action they will take.

 

Definitions

Any word defined below will have the same meaning wherever it is shown in your Plan.

Accident or Collision means a sudden, unexpected event caused by something external and visible, which results directly in loss or damage.

Certificate of Coverage means a validation certificate issued which describes who is covered under this Plan. This is provided along with your confirmation email or invoice.

Country of residence means your place of residence.

Covered/ You/ Your means the person named on the reimbursement plan summary page and any other person who drives the same rental vehicle and is listed on the same rental agreement.

Excess means the amount payable in the event of theft or damage. Excess is charged by the rental companies and can be claimed from RentalCover.com. 

Full Value means the full value of the Excess charges required for you to make a claim.

Plan means this reimbursement Plan that reimburses the full value of the Rental Car Excess charges.

Rental Agreement means the contract provided by a rental company in respect to the provision of a rental vehicle that contains the signature of the Plan holder.

Rental Car company means a commercial operation in business to rent out vehicles that is fully licensed, where applicable, by the regulatory authority of that country, state or local authority including online "share" or "peer to peer" websites, loan cars from a licensed mechanic or accident replacement vehicles.

Rental Vehicle means the private passenger automobile rented from a Rental company at the time the rental contract is signed, including online "share" or "peer to peer" websites, loan cars from a licensed mechanic or accident replacement vehicles. 

RentalCover.com, is a website owned by Cover Genius Pty Ltd which is the claims administrator. 

Tax means a Government tax that is payable by you in addition to the Plan fee.

Theft and Vandalism means a vehicle that has been stolen or damaged, to either a known or unknown location, without your permission.
